This book is the first systematic study of the objections to jurisdiction and admissibility in investment arbitration by the International Centre for Settlement of Investment Disputes (ICSID). The authors outline the legal principles that govern access to ICSID arbitration. Bringing clarity to an area often treated in a fragmented way, they explain when an ICSID tribunal may choose to hear a dispute between a foreign investor and a state, and when it may refuse to do so.

Sebastián Green Martínez joined the International Litigation and Arbitration team at Uría Menéndez in 2018 and has held the position of Managing Associate since 2024. Previously, he worked as a lawyer for the National Directorate of International Affairs of the Treasury Attorney’s Office of the Argentine Republic, where he represented that country in more than 15 arbitration proceedings administered by the International Centre for Settlement of Investment Disputes (ICSID), the Permanent Court of Arbitration (PCA) and the International Chamber of Commerce (ICC). As part of his postgraduate studies at George Washington University Law School, he served as an arbitration assistant to the honorable Charles Brower. Sebastian serves as an arbitrator and is a member of a number of permanent panels of arbitrators and a member of the Committee on Protection of Cultural Heritage during Armed Conflict of the International Law Association. He is also recognized as a Future Leader in the field of arbitration by the legal directory Who’s Who Legal. He is a professor of International Arbitration at the Universidad Francisco Marroquín and teaches public international law at the Universidad Autónoma de Madrid and IE University. He has previously taught at the Universidad Carlos III and UNIR. He is co-author of the book ‘Saberes jurídicos y estrategias para litigar ante instancias internacionales’ (Legal knowledge and strategies for litigating before international bodies). He is also a lecturer (on leave of absence) at the Universidad de Buenos Aires. He has published numerous research articles and chapters on public international law, investment arbitration and cultural heritage. He is a regular speaker at specialized legal conferences and congresses. He is a peer reviewer for numerous scientific legal publications, including the ICSID Review Journal.
